Terms of Service

1. Introduction

Welcome to crafted folio. These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Eligibility and Age Requirements

You must be at least 13 years of age to use our Services. By accessing or using the Services, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18 years of age, you represent that you have obtained permission from your parent or legal guardian to use the Services and that they have agreed to these Terms on your behalf.

If we discover that a person under 13 has provided us with personal information, we will delete such information and terminate the associated account immediately.

3. Account Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

Our Services allow you to create, upload, store, and share content, including but not limited to text, images, and personal information on digital cards, portfolios, and other user-generated content. You retain all rights to your content, but you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, and distribute your content in connection with the Services.

You represent and warrant that you own or have the necessary rights to your content and that your content does not violate the rights of any third party, including intellectual property rights and privacy rights.

5. Third-Party Links, Content, and Transactions

Our Services allow users to include external links, payment links, social media links, and other third-party content in their portfolios and digital business cards. We do not control, endorse, sponsor, recommend, or otherwise accept responsibility for any such third-party content, websites, services, or transactions.

When you click on links in a portfolio or digital business card, or when you make any purchases, payments, or transactions through external payment processors, donation platforms, e-commerce sites, or other third-party services linked from user content, you do so entirely at your own risk. We are not a party to any such transactions and shall not be liable for any damages, losses, or disputes arising from or related to:

  • External links or third-party websites accessed through portfolios or digital cards
  • Payments, purchases, or financial transactions conducted through third-party payment processors
  • Products, services, or digital goods purchased through external links
  • Donations or contributions made through external platforms
  • Any representations, warranties, or claims made by third parties
  • Privacy practices of third-party websites or services
  • Accuracy, legality, or appropriateness of third-party content

You acknowledge that any reliance on third-party content or engagement with third-party services is at your sole discretion and risk. We encourage you to review the terms of service and privacy policies of any third-party websites or services that you visit or use.

5.6 User-Provided Payment Details and Contact Information

Our Services allow users to display personal payment information (including but not limited to UPI IDs, bank account details, cryptocurrency wallet addresses, PayPal IDs, Venmo handles, and other payment identifiers) and contact information (including email addresses, phone numbers, physical addresses, and social media handles) on their portfolios and digital business cards. These are provided directly by users for the purpose of enabling direct peer-to-peer transactions and communications.

5.6.1 No Platform Involvement in Transactions

IMPORTANT: We are NOT a payment processor, financial intermediary, payment gateway, or money transmitter. We do not:

  • Process, facilitate, authorize, or handle any payments made through user-provided payment details
  • Verify the authenticity, accuracy, or legitimacy of any payment information displayed by users
  • Act as an escrow service, guarantor, or intermediary in any transaction
  • Have any visibility into, control over, or involvement in payments made to UPI IDs, bank accounts, or other payment methods displayed by users
  • Verify or validate the identity of users displaying payment information
  • Monitor, track, or record transactions between users and third parties

Our platform merely provides a display space for user-provided information. Any payments you make using displayed payment details are direct peer-to-peer transactions between you and the user, completely outside our platform and beyond our control.

5.6.2 UPI and Direct Payment Method Disclaimer (India)

For Indian Users: UPI (Unified Payments Interface) transactions and other direct payment methods (NEFT, RTGS, IMPS, bank transfers, etc.) are:

  • Instant and Irreversible: UPI transactions are processed immediately and cannot be reversed or charged back
  • No Buyer Protection: Unlike credit card or PayPal transactions, UPI offers no fraud protection, dispute resolution, or refund mechanisms
  • Unverified: We do not verify UPI IDs, QR codes, or bank account details displayed by users
  • Direct Risk: You bear all risk of fraud, scams, misrepresentation, or loss when making payments to displayed UPI IDs or bank accounts
  • No Recovery: Once money is sent via UPI or direct bank transfer, recovery is extremely difficult and generally requires legal action directly against the recipient

We strongly recommend conducting your own due diligence before making any payments. Verify the identity of recipients independently, use secure payment methods with buyer protection when possible, and never send money for goods or services you have not received or from sellers you do not trust.

5.6.3 Contact Information Disclaimer

Email addresses, phone numbers, physical addresses, and social media handles displayed on portfolios and digital cards are provided directly by users. We do not:

  • Verify the accuracy, ownership, or legitimacy of any contact information
  • Confirm that the person displaying contact information has the right to do so
  • Monitor, filter, or control communications made to displayed contact information
  • Assume any responsibility for misuse, unauthorized disclosure, or fraudulent use of contact details
  • Guarantee that contact information is current, working, or monitored by the user

Users display contact information at their own risk. We are not responsible for spam, phishing attempts, harassment, unwanted solicitation, identity theft, doxxing, or any other misuse of publicly displayed contact information.

5.6.4 No Liability for User-to-User Transactions and Communications

We expressly disclaim all liability and responsibility for any damages, losses, disputes, or claims arising from or related to:

  • Payment Fraud: Fraudulent UPI IDs, fake payment details, scam QR codes, or stolen payment information
  • Transaction Disputes: Non-delivery of goods or services, payment disputes, refund requests, or quality issues
  • Financial Loss: Money lost through payments to displayed payment details, whether due to fraud, mistake, or otherwise
  • Identity Theft: Misuse of payment or contact information for fraudulent purposes
  • Unauthorized Access: Hacking, phishing, or unauthorized access to accounts linked to displayed payment or contact information
  • Spam and Harassment: Unwanted communications, spam, phishing attempts, or harassment via displayed contact details
  • Data Scraping: Harvesting, scraping, or unauthorized collection of payment or contact information by third parties
  • Reputational Harm: Damage to reputation resulting from disputes, fraud claims, or negative interactions
  • Legal Violations: Use of payment or contact information in violation of applicable laws or regulations
  • Tax Obligations: Any tax liabilities, reporting requirements, or compliance obligations arising from transactions

5.6.5 User Representations and Responsibilities

If you display payment or contact information, you represent and warrant that:

  • You have the legal right and authority to display such information
  • The information is accurate, current, and belongs to you
  • You are not using the information for fraudulent, illegal, or unauthorized purposes
  • You comply with all applicable laws, including anti-money laundering (AML), know-your-customer (KYC), and tax regulations
  • You accept all risks of publicly displaying payment and contact information, including fraud, spam, and misuse
  • You will promptly update or remove information that becomes inaccurate or compromised
  • You are solely responsible for all transactions conducted using your displayed payment information

If you make payments or contact users, you acknowledge that:

  • You are engaging in a direct peer-to-peer transaction or communication entirely at your own risk
  • You have conducted appropriate due diligence before sending money or sharing information
  • You understand that payments via UPI, bank transfer, or other direct methods are typically irreversible
  • You will not hold us liable for any disputes, fraud, or losses arising from such transactions or communications
  • You are responsible for verifying the identity and legitimacy of recipients before transacting
  • You comply with all applicable laws when making payments or communications

5.6.6 Security Recommendations

To protect yourself when displaying or using payment and contact information:

  • Use Business Details: Display business email addresses and payment accounts rather than personal ones
  • Enable Two-Factor Authentication: Secure all accounts linked to displayed payment information with 2FA
  • Monitor Transactions: Regularly check payment accounts for unauthorized activity
  • Verify Before Paying: Confirm recipient identity through multiple channels before sending money
  • Use Secure Methods: When possible, use payment methods with buyer protection (escrow, credit cards, verified platforms)
  • Document Agreements: Keep written records of transaction terms, agreements, and communications
  • Report Suspicious Activity: Immediately report suspected fraud to relevant authorities and payment providers
  • Limit Exposure: Only display the minimum contact and payment information necessary for your purposes

5.6.7 Reporting Fraud and Abuse

If you encounter fraudulent payment information, scam attempts, or abusive use of contact details on our platform, please report it to us at support@craftedfolio.com. While we will investigate reports and may remove violating content or suspend accounts, we cannot:

  • Recover funds sent to fraudulent payment details
  • Mediate disputes between users
  • Provide legal assistance or representation
  • Guarantee prevention of all fraudulent activity
  • Compensate you for losses incurred

For financial fraud, also report to:

  • India: Cyber Crime Portal (cybercrime.gov.in), National Cyber Crime Reporting Portal, your bank's fraud department, and local police
  • Other Countries: Your local law enforcement, financial regulator, and payment provider's fraud department

6. Prohibited Conduct

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe upon or violate the rights of others
  • Upload, transmit, or distribute harmful or malicious code
  • Interfere with or disrupt the Services or servers
  • Collect or store personal data about other users without their consent
  • Use the Services for any illegal or unauthorized purpose

7. Intellectual Property Rights

The Services and its contents, features, and functionality, including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. DMCA Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of copyright infringement and may terminate the accounts of repeat infringers.

8.1 Filing a DMCA Notice

If you believe that content on our Services infringes your copyright, please provide our designated copyright agent with the following information in writing:

  • A physical or electronic signature of the copyright owner or person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the infringing material and information reasonably sufficient to permit us to locate the material (e.g., URL of the portfolio or digital card)
  • Your contact information, including your address, telephone number, and email address
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

8.2 Counter-Notice

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notice with our copyright agent containing the following:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the person who filed the original DMCA notice or their agent

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability.

9. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Services will immediately cease.

10. Service Availability and Discontinuation

We reserve the right to modify, suspend, or discontinue the Services or any part thereof (including but not limited to digital cards, portfolios, user content, and associated links) at any time, with or without notice. You acknowledge and agree that we shall not be liable to you or to any third party for any modification, suspension, discontinuation, or unavailability of the Services or any part thereof. This includes, but is not limited to, any loss of data, content, or access, and any resulting damages or inconvenience.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
